Plaintiffs’ Experts Will Get Their Day in Court in Talc Cancer Lawsuits
This past week Chief Judge Freda L. Wolfson’s ruling on what expert testimony may be used in the Johnson & Johnson (“J&J”) talcum powder ovarian cancer suits came out on the side of the plaintiffs. After J&J‘s attempts to block plaintiffs’ experts from speaking on the presence of asbestos in J&J’s talcum products and studies demonstrating that J&J’s products can cause cancer, the Court ruled that Plaintiffs’ experts will be allowed to testify. After passing this hurdle, the plaintiffs can continue their cases before the U.S. District Court of New Jersey.
