Burns Charest’s Amanda Klevorn has been appointed as a member of the Plaintiffs’ Steering Committee in a federal class action against the creators of the hit social media app, TikTok. The plaintiffs in the MDL allege that defendants TikTok, Inc., ByteDance, Inc., and Beijing ByteDance Technology Co. Ltd, violate Illinois’ Biometric Information and Privacy Act (“BIPA”) and other federal and state consumer privacy laws by collecting and using TikTok App users’ biometric data and video viewing histories. TikTok’s users, many of whom are minors, are not notified that defendants capture and use their personal, sensitive data in this manner.

Burns Charest filed the first BIPA class action lawsuit in the country against the TikTok defendants on April 30, 2020 in the U.S. District Court for Northern District of California. The case was later transferred to the U.S. District Court for the Northern District of Illinois for coordinated proceedings.
