SCOTUS Allows Class Action Against AviaGames to Move Forward

The U.S. Supreme Court has declined to consider defendant AviaGames's petition to compel arbitration in a federal consumer class action filed by attorneys with Burns Charest. The class action filed in the Northern District of California alleges the company manipulates gameplay by pitting players against computer bots, instead of matching human competitors of comparable skill levels against each other as advertised. The class could involve millions of individual consumers who have wagered more than $1 billion in recent years to compete in Avia’s online games.

"We want to see these people brought to justice. It's amazing, the amount of losses and the sad stories that we've encountered—people ... who've been duped and don't know where to turn," said firm partner Matt Tripolitsiotis in a Law.com article.
